Can You Get Poland Residency by Investment?
Buying property or opening a company in Poland does not automatically give you residence rights. Learn how the business route works, which financial tests matter and what to verify before committing your money.

Poland residency by investment is not a dedicated immigration route like a golden visa. Buying a Polish apartment, acquiring company shares or transferring a set amount of money does not automatically entitle you to live in Poland. Genuine business activity can provide a basis for applying for temporary residence, but the application must meet specific legal and financial conditions.
That distinction matters before you commit money. A company that is inexpensive to register may still be difficult to build into a qualifying business, and an investment that makes commercial sense may offer no immigration benefit at all.
The short answer: Poland has no standard golden visa
Poland does not operate a standard residence-by-investment program that exchanges a qualifying property purchase, government contribution or passive investment for a residence permit.
For British citizens without another qualifying status, post-Brexit immigration rules apply. Having enough money to support yourself does not, on its own, create a long-term residence route. EU citizens and people protected by the Withdrawal Agreement have different rules, so establish which framework applies to you first.
The practical distinction is straightforward:
| Action | Does it establish residence rights? | |--------|-------------------------------------| | Buying an apartment | No, ownership is not a residence permit | | Depositing money in a Polish bank | No, savings alone do not create a residence route | | Registering a company | No, incorporation and immigration permission are separate | | Undertaking qualifying business activity | It may support an application for temporary residence |
An offer advertising Poland residency by investment should therefore identify the actual legal basis for the application, rather than simply name an investment amount.
Ask whether the proposed route depends on business performance, your role in the company or another independent basis for residence. If those details are missing, you do not yet have a usable immigration plan.
The business route behind Poland residency by investment
The relevant route for many entrepreneurs is a temporary residence permit for conducting business activity. This is an immigration application connected to a qualifying business purpose, not a reward for purchasing an asset.
The legal framework includes Article 142 of Poland’s Act on Foreigners. Applicants must satisfy the applicable personal requirements as well as the business-related conditions.
Your role matters. Running an eligible business, serving on the management board of a company in which you hold shares and merely owning a passive investment are not interchangeable situations. The correct residence and work arrangements depend on what you will actually do.
For someone researching Poland residency by investment, the useful question is whether their proposed activity fits the business residence rules, not whether they can afford a particular investment package.
You will generally need evidence addressing health insurance, a stable and regular source of income and the business purpose of your stay. Company records, financial documents and evidence of genuine operations help establish that purpose. The exact requirements depend on the application and your circumstances.
The business income and employment tests
The statutory business conditions are more substantial than registering a company. In simplified terms, the business must meet an income or employment test, or demonstrate the resources and measures needed to meet one of those tests in the future.
| Basis | What it involves | |-------|------------------| | Business income | Income in the preceding tax year of at least 12 times the relevant province’s average monthly gross wage for the third quarter of the preceding year | | Employment | At least two qualifying employees, employed full-time on indefinite contracts for at least one year before the application | | Future qualification | Evidence of resources and measures that will enable the business to meet the income or employment condition in the future |
The employment category covers Polish citizens and specified categories of foreign nationals. It is not enough to assume that any two contractors or recently hired workers will qualify.
The income test is also not simply a turnover target. Company valuation, sales revenue and cash contributed by a shareholder are different figures. A Polish accountant should confirm which financial records establish the relevant income and which provincial benchmark applies.
These conditions explain why Poland residency by investment cannot be reduced to a fixed national price: the assessment concerns the business and the applicant, rather than a single capital transfer.
Can a new business qualify before it has a trading history?
A new venture may be able to rely on the future-qualification provision. That does not mean every startup with a business plan will receive approval.
Evidence can include available funding, signed customer contracts, a credible hiring plan, investment in equipment or premises and activities contributing to innovation or job creation. The application needs to explain how these resources and actions will lead to the required business results.
A forecast is more persuasive when its assumptions can be checked. For example, a signed service contract supports expected revenue more directly than a statement that the company intends to find clients after the founder receives residence.
Be cautious if someone markets Poland residency by investment through an empty company and treats future trading as a formality. A newly incorporated entity still needs a credible business purpose and evidence appropriate to the legal test.
Before relying on this provision, have an immigration lawyer assess the application strategy and an accountant test the commercial assumptions. Neither a polished business plan nor available capital guarantees approval.
How much money would you actually need?
There is no universal investment amount that guarantees a Polish residence permit.
A Polish limited liability company, known as a spółka z ograniczoną odpowiedzialnością or sp. z o.o., has minimum share capital of PLN 5,000. That is a company formation requirement, not a residency threshold. Poland’s official business portal provides guidance on company structures and operating requirements.
A realistic budget must account for the business itself, your household and professional support. Accounting, insurance, payroll, premises and taxes can all matter, depending on the activity. Your company’s money and your personal living funds also need to be treated correctly.
When comparing a Poland residency by investment proposal, ask for separate figures for share capital, operating costs, personal living expenses and advisory fees.
Do not assume that money contributed to a company can simply be withdrawn whenever you need it. The treatment of capital contributions, shareholder loans, salaries and dividends differs.
Property ownership adds another separate issue. Some foreign buyers and property types require purchase authorization, while exemptions apply in other cases. Even where a purchase is permitted, it does not solve your immigration status.

Residence, work rights and tax are separate checks
Owning a Polish company does not automatically authorize every activity you might perform for it. Managing the company, delivering services and working as its employee may require different analysis.
Before you begin, establish whether your nationality, immigration status and proposed role require work authorization, and whether your eventual residence permit covers that role. The work permit rules for foreigners in Poland provide useful background, but a business owner’s situation needs its own assessment.
Tax is another independent question. Becoming a shareholder does not automatically make you a Polish tax resident, and retaining UK clients or a UK company does not automatically keep you outside the Polish tax system.
For British founders continuing to earn from the UK, the guide to Polish tax considerations for UK remote workers explains why residence, work location and cross-border income need to be considered together.
A credible Poland residency by investment plan must address immigration permission, work rights and tax obligations separately. Solving one does not settle the other two.
Family members also need an appropriate basis for residence. Do not assume that a business application automatically covers a spouse or children, or that everyone can relocate on the same timetable.
What happens after a business residence application?
A business-based temporary residence permit can be issued for up to three years, depending on the circumstances. It is not permanent residence, and its continued usefulness depends on maintaining the relevant conditions.
Your application strategy should account for lawful entry and stay, where the application must be made and the evidence required by the responsible authority. Registering a company does not itself authorize you to remain in Poland while preparing an application.
A properly filed in-country application can keep your stay lawful in Poland during processing, subject to the applicable requirements. However, pending-application status is not a substitute for a visa or residence card for international travel, and it does not automatically create unrestricted work rights.
Poland residency by investment should not be presented as an immediate route to permanent status or a Polish passport.
An EU long-term resident permit may become relevant after five years of qualifying legal and uninterrupted residence. Eligibility also involves income, health insurance and recognized evidence of Polish-language proficiency, generally at least B1. Rules on counted residence periods and absences matter, so five calendar years are not automatically enough.
Citizenship is a separate process. The guide to Polish citizenship routes, rules and timelines explains the distinction without treating business investment as a citizenship purchase.
What to verify before committing money
For a proposed move in 2026, confirm the current rules and application requirements before signing a property contract, buying a company or paying a relocation intermediary. Use the Office for Foreigners and the relevant provincial office alongside qualified professional advice.
Request a written explanation of the proposed immigration route. It should identify your qualifying role, the business conditions you intend to satisfy and the evidence available to support them.
Before paying, ask:
- What is the legal basis? The adviser should name the residence category and explain why it fits your circumstances.
- Which business test applies? Establish whether the application relies on existing income, qualifying employees or future performance.
- What does the quoted price cover? Separate company capital, professional fees and ongoing operating costs.
- What happens if residence is refused? Check refund terms, contractual obligations and any business liabilities that remain.
- Who reviews the legal and tax position? Identify the professionals responsible, rather than relying on a sales representative’s assurances.
The main warning sign in a Poland residency by investment offer is a guarantee based solely on spending money. Authorities decide residence applications, not company formation agents or property sellers.
A useful proposal should also explain renewal risks. If the business loses its clients or never reaches its projected performance, you need to understand how that affects your ability to remain in Poland.
Frequently asked questions
Can I get Polish residence by buying an apartment? No. Property ownership does not create a residence entitlement. You still need a qualifying immigration basis, and the purchase itself may be subject to separate rules for foreign buyers.
Does investing PLN 5,000 in a company qualify me? No. PLN 5,000 is the minimum share capital for a Polish limited liability company, not an immigration investment threshold. Company registration and residence approval are separate matters.
Can an entrepreneur apply through a new company? Potentially. A new company may rely on evidence that it has the resources and measures to meet the statutory business conditions in the future. Approval depends on the full application, not incorporation alone.
Is Poland residency by investment available to British citizens? There is no dedicated investor program for British citizens. A British entrepreneur may qualify for business-based temporary residence if the relevant conditions are met, or may have another residence route based on their circumstances.
Would a Polish residence card let me work anywhere in the EU? No. A Polish permit does not grant a general right to live or work in another EU country. Short visits and relocation for employment are different matters.
Decide on the move before buying into a route
Start with whether Poland fits your household, income and business plans, then establish a lawful route that supports those plans. Do not reverse that process because an investment package sounds convenient.
